What happens when you live in Colombia and a close family member dies leaving property both in Colombia and the United States?
It is very important for families to follow the wishes of the deceased. However, the Colombian courts will only be able to distribute those assets located in Colombia.
The assets located in the United States will need to be distributed by the US courts. In Florida, this process is called an ancillary proceeding. Under the ancillary proceeding, the Florida court will follow the decedent’s wishes with respect to the property located in Florida.
